General terms and conditions of sale:
Admission
The activities offered by Takamaka are open to all. However, specific age limits apply to some activities. Likewise, being able to swim is essential for water activities.
Special registration conditions for several people: the person making the booking undertakes to inform all registered participants of, and obtain their approval for:
- the general terms and conditions of sale
- the insurance conditions and any other document provided to them.
Booking
A booking will only be confirmed upon registration with 100% payment at the time of booking.
Cancellations
Cancellation by a participant will result in the application of the following scale: 100% of the amount will be retained, except on presentation of a medical certificate showing inability to take part in the chosen activity.
Changes by the organiser
We reserve the right to change the programme of a stay for safety reasons. The client may not claim any compensation if, due to force majeure, the stay or services have to be cancelled or changed in essential respects. The organiser will endeavour to offer the client a replacement stay or services, and the client will then have 7 days to accept the replacement product or to end the booking at no charge.
NB: where services have already begun, replacement routes or activities will be offered by the organisers.
Changes by the client
Any change by the client to essential elements (change of programme, date, destination, number of participants...) will be treated as a cancellation and will incur the same charges.
Risks
Given the specific nature of our programmes, each participant is aware that they may face certain risks, in particular due to the distance from medical centres. They accept these risks in full knowledge and must comply with safety rules and follow the advice given by the professionals. TAKAMAKA has no means of checking the sporting level of its clients. In the case of sporting activities with or without equipment, and especially in the case of sports equipment hire included in our programmes (excluding programmes supervised by an instructor), clients acknowledge that they have sufficient technical skill to practise this sport on their own and to use the hired equipment on their own. The same applies to any activities or sports equipment hire not included in the programme and/or purchased directly at the place of stay. In such cases, the client takes part in these activities under their sole responsibility and at their own risk.
Insurance
We have taken out a professional civil liability insurance policy with ALLIANZ. Participants must have individual personal accident insurance.
Disputes
Any disputes arising from these conditions shall fall under the jurisdiction of the Commercial Court of Lyon.
